Pro-rated cellular early termination fees?

In which instance(s) are pro-rated cellular Early Termination Fees (ETFs) available?
I hear a lot of talk about pro-rated ETFs, but most of my friends have flat-rate ETFs.
Is it state-specific, e.g. based on state law?
