Terms And Conditions Of Web Hosting Service

The terms and conditions set forth herein constitute the full and complete agreement between you (hereinafter referred to as "Customer," "you" or "your") and GMPHost Ltd. (hereinafter referred to as "GMPHost", "we" or "us").

GMPHost Services Defined

GMPHost, as your web hosting service provider, will supply you with a shared web hosting solution. For all accounts this solution will, at the very least, provide you with the selected amount of server or disk space to upload your website and an allocated amount of bandwidth transfer to allow for website connectivity. As your web hosting provider, we will make available various services and software for setting up, connecting, maintaining or canceling you account.

Upon paying for and using the hosting services provided by GMPHost, Customer indicates his/her agreement to the following terms and conditions, as outlined below. The use and/or payment for GMPHost services constitute an agreement with these terms and conditions. If you do not agree with any of these policies, please contact us immediately.

General Terms

GMPHost requires that Customer information, as listed on the account sign up form, is a complete and accurate representation of Customer contact details.

This agreement supersedes any other oral agreement between GMPHost and Customer.

GMPHost will never require Customer to advertise for GMPHost on his/her Web sites.

Customer is allowed to use his/her sites for commercial or individual Web sites or content.

Any of the terms, prices or services offered can be modified or updated with prior online or email notification.

Customer Responsibility

Customer is responsible for uploading website files and/or providing and setting up any website content. GMPHost is not responsible for modifying or updating website material.

Customer is responsible for the content of any postings, data or transmissions. This responsibility is extended to any individuals or entities given access to the account by the customer.

While GMPHost will assist you in any way reasonable, we are not responsible for ensuring your domain name is transferred to our servers. Customer is responsible for making any necessary domain name server changes, and ensuring the transfer is implemented correctly.

Customer is responsible for updating and maintaining their contact information with GMPHost. Any changes to your contact information must be made using your account Control Panel. Customer is responsible for ensuring that GMPHost is able to notify him/her for technical, billing or other issues or purposes deemed necessary by GMPHost to maintain the account.

Customer is responsible for bandwidth utilization, and monitoring bandwidth use to ensure the website does not exceed the bandwidth allocated for their account(s). Customer acknowledges that GMPHost will use its best efforts to email Customer when they are at or near their bandwidth utilization limit, but that it is Customer's responsibility to ensure a valid email address is on file at GMPHost . GMPHost does not take responsibility for emails not received by Customer pertaining to bandwidth utilization.

Lawful Purpose

GMPHost reserves the right to refuse service to anyone in violation of our Acceptable Use Policy or anyone using our networks or servers for unlawful purposes.

Customer agrees to abide by all terms outlined in our AUP. Any violation of those terms will result in the actions outlined in our AUP.

Customer accepts liability resulting from any breach of our AUP.

Customer is responsible for making their end-users aware of all the GMPHost's policies, and is responsible for any breach of those policies by their end-users, as laid out in our AUP.

Domain Name

Once a domain name has been registered or renewed through GMPHost, no refunds will be given for the domain registration or renewal fee.

The Customer has full ownership rights over any domain name registered or renewed through GMPHost, where the domain registration fees have been paid in full.

No domain name will be registered or renewed without prior payment of the required fee.

If we are unable to secure payment before the domain renewal date, the domain will expire and the hosting account will be suspended.

After 40 days, the domain name will be released by the Registrar Company and be made available to the general public for re-registration.

Once a domain has expired, if the registration fee is then paid, we will put in a request with our Registrar Company to renew and reactivate the domain name. This process is normally complete within four (4) days.

Once a domain has been renewed, if we receive a dispute of payment, a request for a refund from your credit card company, or a check payment is returned due to insufficient funds, GMPHost will take over the ownership of the domain name in question.

GMPHost is not responsible for maintaining the registrant information for domain names. The domain owner can modify all this information using our Control Panel.

GMPHost is not liable for any domain disputes that may arise over changed registrant information for a domain name.

GMPHost is not responsible for resolving any domain disputes. These issues must be resolved by the parties involved, according to the legal bounds of ICANN (Internet Corporation for Assigned Names and Numbers), the domain name governing body. GMPHost will not act as an arbitrator, but will honor any decisions determined by ICANN.

Account Ownership

Ownership of the account is determined by the name and email address provided upon hosting service subscription.

GMPHost is not liable for any account disputes that may arise between various parties holding GMPHost account login information when the information has been distributed by the verified account holder.

GMPHost is not responsible for any changes made to the account or any information that has been modified by Customer, or any parties authorized by Customer, to access the Control Panel.

GMPHost will act in accordance with the above ownership rules unless compelled by a domain dispute ruling as determined by ICANN (Internet Corporation for Assigned Names and Numbers), the domain name governing body.

Payment Policies

2Checkout.com, Inc. (www.2checkout.com) is the authorized retailer of GMPHost's services and products. 2Checkout is a highly reputable company with thousands of business clients, high security level, certified by "30 day money back guaranteed" and "BBBOnline Reliability Seal".

GMPHost currently accepts credit cards (Visa, MasterCard, American Express, Discover/Novus, Diners Club and JCB and derivatives of those brands), personal checks, business checks, money orders, and international money orders. Checks must be in U.S. currency, and must be drawn on a U.S. bank

At the customer's option, accounts are being billed monthly (credit card only), quarterly, semiannually, or annually. Payment is due on the date of each anniversary of the payment period. Credit cards are charged automatically on the anniversary date of the payment period unless we receive written or explicit instructions indicating otherwise.

Initial payments are due in order a GMPHost's service to be performed, regardless of whether the service is being automatically performed or requires an action by a GMPHost employee. Initial payments are not required only in case of explicitly announced promotional services.

GMPHost does not charge any setup fees for their services.

Customers will be invoiced via email. Those paying by checks are invoiced 1 month before payment is due. Those paying by credit cards are invoiced 1 day before payment is automatically charged.

Checks returned unpaid (i.e. insufficient funds) are subject to a returned check fee.

If a chargeback is submitted against a credit card used to purchase service, the account(s) in question will be suspended immediately. There is a processing fee to re-activate.

Accounts that are 30 days delinquent in payment of balances due will receive a reminder email. If payment, in full, is not received within 7 days of the reminder, the account will be suspended. Accounts which remain suspended more than 2 weeks are subject to termination.

Accounts which are reactivated after having been suspended are subject to an account reactivation fee.

Hosting plan changes are possible at the end of the payment period as well as in the middle of the period. The customers are not being refunded, but are being indemnified through various GMPHost services.

Cancellation Policies

GMPHost reserves the right to refuse service to anyone in violation of our Acceptable Use Policy or anyone using our networks or servers for unlawful purposes. Should GMPHost cancel service, prepaid monthly fees for service not rendered will be prorated and refunded.

If you do not wish to continue hosting with GMPHost, or do not wish to renew your domain name, it is your responsibility to contact our Support Department to cancel your account or domain name.

Transferring a domain to a new hosting company does not constitute canceling an account with GMPHost.

Customers may cancel their accounts at the end of their billing period. In this case, prepaid monthly fees for service not rendered will be prorated and refunded.

Any account canceled within 30-days of the initial sign-up will receive a full refund for any paid for hosting fees. This refund does not include the domain registration.
